In the context of the adoption of the Member State law on which the performance of the tasks of the public authority or public body is based and which regulates the specific processing operation or set of operations in question, Member States may deem it necessary to carry out such assessment prior to the processing activities.

In Luxembourg, the law of 1 August 2018 organising the National Commission for Data Protection and the general data protection regime sets out the modalities for prior consultation of the CNPD on public sector processing grounded in national law. The CNPD plays an advisory role on draft laws and grand-ducal regulations establishing data processing, consistent with Article 57(1)(c) GDPR and recital 93.

Luxgap practice: for any municipality, ministry or public establishment preparing a normative text grounding a processing operation, trigger the DPIA at the preliminary draft stage and anticipate the CNPD referral before the Conseil d'Etat opinion, not after.
