The classic trap
Recital 4 sets out the proportionality principle: data protection is not an absolute right and must be balanced against freedom to conduct a business, freedom of expression, and the right to an effective remedy. In practice, the CNPD and the CNIL sanction both controllers who over-collect in the name of security and those who invoke freedom to conduct a business to justify disproportionate surveillance of employees or visitors. This recital is the key argumentation tool before the authority: without a documented proportionality test, your defence file is empty.
The proportionality test: the enforceable analytical grid
A credible proportionality test rests on four layers, all documented ex ante and not reconstructed after an inspection:
- Legitimacy: is the pursued objective a recognised legitimate interest (security, anti-fraud, commercial performance) or mere convenience?
- Necessity: does a less intrusive measure achieve the same objective (pseudonymisation, aggregation, sampling, shorter retention)?
- Adequacy: does the chosen measure actually achieve the objective, or is it cosmetic (CCTV that deters nothing, biometrics that adds nothing over a badge)?
- Balancing: which competing fundamental right (privacy, freedom of expression, non-discrimination) is affected, and to what extent?
Recital 4 acts as the interpretive anchor for Article 6(1)(f), Article 35 (DPIA), and any argumentation built on the legitimate interest legal basis.
