Where personal data are processed for statistical purposes, this Regulation should apply to that processing. Union or Member State law should, within the limits of this Regulation, determine statistical content, control of access, specifications for the processing of personal data for statistical purposes and appropriate measures to safeguard the rights and freedoms of the data subject and for ensuring statistical confidentiality. Statistical purposes mean any operation of collection and the processing of personal data necessary for statistical surveys or for the production of statistical results. Those statistical results may further be used for different purposes, including a scientific research purpose. The statistical purpose implies that the result of processing for statistical purposes is not personal data, but aggregate data, and that this result or the personal data are not used in support of measures or decisions regarding any particular natural person.

In Luxembourg, STATEC is the national statistical authority and the law of 10 July 2011 organising the National Institute of Statistics and Economic Studies imposes reinforced statistical secrecy, distinct from the GDPR: STATEC staff and partners are bound by criminally enforceable professional secrecy. The CNPD oversees the interplay between public and private statistical processing, and the law of 1 August 2018 specifies the article 89 safeguards applicable to statistical processing in Luxembourg.

How to comply

The classic trap

Recital 162 draws a sharp line that many organisations cross without realising it: processing only qualifies as genuinely statistical when the output is aggregate data and neither the result nor the underlying personal data supports any measure or decision targeting an identified individual. The CNPD and CNIL routinely reclassify as profiling or marketing those activities labelled "statistical" once the output enables individual retargeting (customer scoring, HR segmentation, churn prediction). The EDPB reminds in its purpose limitation guidance that the "statistical" label does not suspend minimisation or the obligation to identify a lawful basis.

The 4-question test to qualify a genuine statistical processing

Aggregate output? Is the final deliverable an average, count, distribution, with no re-identification possible even through cross-referencing?
No individual decision? The result is never used to target, score, exclude or contact a specific person.
Access segregation? Analysts work in a dedicated environment, separated from operational databases, with audit logs.
Justified retention? Raw data are deleted or pseudonymised as soon as the aggregate is produced, consistent with article 89.

If any answer is "no", you are not in the statistical regime of recital 162: you must requalify the purpose, redo the lawful basis analysis and likely trigger a DPIA.
