Sous-chapitre 5.4. : Organisation de la lutte contre le blanchiment de capitaux et le financement du terrorisme 302. Le présent sous-chapitre s’applique à chaque GFI ainsi qu’à chaque succursale d’un GFI dont le siège social se situe dans un Etat membre ou dans un pays tiers, tel que visé à l’article 1er (3bis) point f) de la LBC/FT. 303. La section 5.4.1. précise le cadre général et les obligations incombant à chaque GFI, indépendamment des fonctions qu’il exerce telles que visées au point 4 de la présente circulaire. 304. La section 5.4.2. traite des obligations applicables au GFI. Ainsi, la section 5.4.2. distingue quatre cas de figure selon la manière dont sont organisées la relation avec les intermédiaires de la commercialisation et la fonction d’agent teneur de registre. En ce qui concerne les cas b), c) et d), des obligations en matière de LBC/FT s’appliquent non seulement au GFI mais également à l’entité exerçant la fonction d’agent teneur de registre.

In Luxembourg, the AML/CFT framework applicable to IFMs stems from the amended Law of 12 November 2004 on the fight against money laundering and terrorist financing, supplemented by the Grand-Ducal Regulation of 1 February 2010 and by CSSF Regulation 12-02. The CSSF is the competent supervisory authority and may impose administrative sanctions, while suspicious transaction reports are filed with the CRF. The compliance officer (RR) and compliance control officer (RC) functions must be approved by the CSSF.
Luxgap practice: we systematically verify that the chosen setup (a, b, c or d) is consistent with the delegation agreements actually signed, as this is the first point examined during a CSSF on-site inspection.
