The classic trap
This recital targets a blind spot of internal schemes: public health and consumer safety. In practice, companies calibrate their reporting channel on financial fraud and harassment, but forget product-related reports (manufacturing defects, CE marking workarounds, undeclared additives, avoided recalls). As a result, an employee witnessing an unsafe product placed on the market has no clear channel, bypasses the internal route and reports directly to ILNAS, DG Sante or the press. OFRS and ITM then consider the internal scheme as deficient, which strips the employer of protection in case of retaliation claims.
Product-related disclosures to integrate into your channel
- Non-compliance with a sector regulation (toys 2009/48/EC, cosmetics 1223/2009, medical devices MDR, food safety 178/2002, REACH).
- Circumvention of quality tests, falsified certificates or unjustified CE marking.
- Concealment of a pharmacovigilance or materiovigilance signal.
- Delayed or minimised product recall to preserve revenue.
- Commercial pressure to sell off stock identified as defective.
- Supplier unilaterally changing a critical formulation or component.
The channel must explicitly mention these categories in its documentation, otherwise the whistleblower can legitimately consider they are not covered and move directly to the external channel.
