Repeal
Directive (EU) 2016/1148 is repealed with effect from 18 October 2024.
References to the repealed Directive shall be construed as references to this Directive and shall be read in accordance with the correlation table set out in Annex III.
In Luxembourg, the repeal of NIS 1 and the shift to NIS 2 are carried by the Law of 28 July 2023 on cybersecurity, amended by the Law of 28 July 2025, which transposes the Directive into national law. The ILR designates essential and important operators, receives incident notifications, runs inspections and imposes administrative sanctions (up to EUR 10m or 2 percent of worldwide turnover for an essential entity). Your documentary references must point not only to NIS 2 but also to the applicable Luxembourg transposition text.
