In order to carry out third-party conformity assessments when so required, notified bodies should be notified under this Regulation by the national competent authorities, provided that they comply with a set of requirements, in particular on independence, competence, absence of conflicts of interests and suitable cybersecurity requirements. Notification of those bodies should be sent by national competent authorities to the Commission and the other Member States by means of the electronic notification tool developed and managed by the Commission pursuant to Article R23 of Annex I to Decision No 768/2008/EC.

In Luxembourg, the national competent authority for notifying conformity assessment bodies under the AI Act has not yet been formally designated. ILNAS (Luxembourg Institute of Standardisation, Accreditation, Safety and Quality of Products and Services) remains the historical OLAS accreditation authority and the natural candidate to carry the electronic notification to the Commission via NANDO, in coordination with the EU AI Office.

Luxgap practice: until the Luxembourg designation is finalised, favour notified bodies already active in other Member States (DE, FR, NL) for your high-risk AI systems, and maintain ILNAS monitoring to switch as soon as the LU notification becomes effective.
