Reporting of infringements and protection of reporting persons
Directive (EU) 2019/1937 shall apply to the reporting of infringements of this Regulation and the protection of persons reporting such infringements.
In Luxembourg, whistleblower protection transposing Directive (EU) 2019/1937 falls under the law of 16 May 2023, which requires an internal reporting channel for entities with at least 50 employees and gives a support role to the Office des signalements. For AI Act infringements, this national framework governs the 7-day acknowledgement, the 3-month feedback and the prohibition of retaliation, with a reversed burden of proof on the employer.
