Notification duties

Member States shall notify the laws, regulations and administrative provisions implementing this Chapter, including any relevant criminal law provisions, to the Commission, ESMA, the EBA and EIOPA by 17 January 2025. Member States shall notify the Commission, ESMA, the EBA and EIOPA without undue delay of any subsequent amendments thereto.

In Luxembourg, the CSSF exercises the supervisory and sanction powers set out in Chapter VII of DORA for the entire supervised financial sector. Transposition is carried by the law of 1 August 2024 on DORA and operationally implemented through CSSF circulars 25/881 (amending 20/750 on ICT risk management), 25/883 (amending 22/806 on outsourcing) and 25/882 (third-party ICT services). DORA administrative sanctions may reach up to 1 percent of average daily turnover, in addition to any criminal provisions notified under Article 53.
